Terms of Service

These Terms of Service form a binding agreement between you and DrivPrep and govern your access to DrivPrep.com. Please read them carefully — by using the platform you accept them in full.

1. Acceptance of these terms

By accessing or using DrivPrep.com (the "Platform"), you agree to be bound by these Terms of Service and by our Privacy Policy and Cookie Policy, which are incorporated here by reference. If you do not agree, please do not use the Platform.

2. Eligibility

The Platform is intended for people preparing for, holding or renewing a United States driver's license or learner permit. It is not directed to children under 13. If you are under 18, you may use the Platform with the involvement of a parent, guardian or driving instructor, who accepts these terms on your behalf.

3. Educational purpose and no affiliation

DrivPrep provides educational material about driving and traffic law in the United States. We are an independent platform and are not affiliated with, endorsed by, sponsored by or operated by any state Department of Motor Vehicles, licensing authority or government agency.

Our practice tests are study tools, not official examinations. Question wording, scoring and pass thresholds approximate common state formats but are not the actual exam, and a passing score on DrivPrep does not guarantee a passing score on any state test. Content is general educational information, not legal advice and not a substitute for behind-the-wheel instruction. Always confirm current requirements with your state's official driver handbook and licensing authority.

4. Acceptable use

You agree to use the Platform lawfully and for personal, educational purposes. You may not:

  • scrape, crawl at abusive rates, mirror, republish, resell, sublicense or systematically copy our questions, explanations, articles or data;
  • use the content to train, fine-tune or build a competing question bank or dataset without our written permission;
  • interfere with or attempt to compromise the security, availability or integrity of the Platform, including probing, load testing or bypassing access controls;
  • introduce malware, automated bots or scripts that degrade service for other users;
  • misrepresent your relationship with DrivPrep, impersonate our staff, or use our name or branding in a way that implies endorsement;
  • use the Platform in any way that violates applicable law or the rights of others.

We may suspend or restrict access to anyone who breaches this section, without prior notice where necessary to protect the service.

5. Study data and accounts

Study progress is currently stored in your own browser rather than on our servers. You are responsible for the device and browser you use. Clearing site data, switching browsers or using private browsing will permanently remove your saved progress, and we cannot recover it. If account-based features launch, you will be responsible for keeping your credentials confidential and for activity under your account.

6. Intellectual property

All content on DrivPrep — including questions, explanations, guides, page copy, layout, design, graphics and branding — is original work owned by DrivPrep or used with permission, and is protected by copyright, trademark and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the content for your own study.

You may link to our pages and quote short excerpts with clear attribution and a link back. Any other reproduction, distribution or derivative use requires our prior written consent.

7. User submissions and feedback

If you send us feedback, corrections or suggestions, you grant us a perpetual, worldwide, royalty-free licence to use them to improve the Platform, without obligation of compensation or attribution. Do not send us confidential information or material you do not have the right to share.

The Platform may display advertising and may link to third-party sites such as state licensing authorities. We do not control third-party content, products or privacy practices and are not responsible for them. Links are provided for convenience and do not imply endorsement. Any dealings with advertisers or linked sites are between you and that third party.

9. Paid plans and premium features

Premium features described on our pricing page may not yet be available. When paid plans launch, additional billing terms — including price, billing cycle, renewal, cancellation and refund policy — will be presented clearly before any purchase, and no charge will be made without your explicit agreement.

10. Availability and changes to the Platform

We aim for continuous availability but do not guarantee it. We may modify, suspend or discontinue any part of the Platform, including specific tests, guides or features, at any time and without liability to you.

11. Disclaimer of warranties

The Platform is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We work to keep content accurate and current, but traffic law changes frequently and errors are possible. We do not warrant that the content is complete, error-free, or applicable to your specific state or situation.

12. Limitation of liability

To the fullest extent permitted by law, DrivPrep and its contributors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or study progress, arising from or related to your use of the Platform — including the outcome of any examination, licensing decision or driving decision. Our total aggregate liability for any claim relating to the Platform will not exceed the greater of the amount you paid us in the twelve months before the claim or fifty U.S. dollars. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless DrivPrep and its personnel from any claim, demand, loss or expense (including reasonable legal fees) arising out of your misuse of the Platform, your breach of these terms, or your violation of any law or third-party right.

14. Termination

You may stop using the Platform at any time. We may terminate or restrict your access if you breach these terms or if we discontinue the service. Sections that by their nature should survive termination — intellectual property, disclaimers, liability limits and indemnification — will continue to apply.

15. Governing law and disputes

These terms are governed by the laws of the United States and of the State of Delaware, without regard to conflict-of-law rules. You and DrivPrep agree to attempt in good faith to resolve any dispute informally by contacting us first. If that fails, disputes will be brought in the state or federal courts located in Delaware, except where mandatory consumer protection law in your place of residence gives you the right to bring proceedings locally.

If you believe content on the Platform infringes your copyright, send a notice to support@drivprep.com identifying the work, the material in question, your contact details and a statement of good-faith belief. We will investigate and remove infringing material where appropriate.

17. Miscellaneous

These terms, together with the Privacy and Cookie Policies, are the entire agreement between you and DrivPrep regarding the Platform. If a provision is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver. You may not assign these terms; we may assign them in connection with a merger or asset transfer.

18. Changes and contact

We may modify these terms; the revision date appears at the top, and continued use after a change constitutes acceptance. Questions can be sent to support@drivprep.com or through our contact page.
